How long does take to get a permanent green card if you applied to remove cond.s |

I have been marreid a little more then 3 years.Last year february,2003 we applyed to remove my cond.status based on marriage.I got a form from INS that it takes a minimum to process this form 30 days.We have been waiting for 8 months,we still didn't get anything. My question is can i apply for citizenship if i still live with my american husband,if i only have a 2 years green card,but have been married for more then 3 years or should i wait for my permanent green card and then to apply,or it better to get a legal help regarding my case? Thank you very mush in advance.

Thank you so much.As a matter of fact i was trying to check my status on line.but when i put my number in,it said that nothing is found.I am sure i put the right number,because all my friends can check their status on line.May be something is wrong with my case.Should i wait and see what will happen or should i write them a letter,or shoud i hire a loyer to check the status of my application to remove condit.It has been 8 months and i really need to go to Ukraine.My temp.green card is about to expare in April and i want to go in May.Thanks

It took 18 months to approve my application. They work very slow.If your card is about to expire, then go to BCIS office in Boston and make them stamp your passport, to extend your legal stay in here. Actually, you can call directly National BCIS office and ask what to do in your case. I did many times and always had info. I needed.No lawyers needed.

Thank you so much for the answer.But what if my husband wants to get a divorce,and i still didn't get my permanent g.c and we have been living for 3,5 years will i get my g.c any way since we applyed together almost a year ago to remove my conditional status or no.Thanks.

Can not answer for sure, because do not know what you have sent with your application. I sent:
.1.Proof of joint residence. 2. Joint financial stataments.3 Property Deed. 4. Birth Certificate of Child (born to marriage)
Since I sent complete info, I received Notice of Approval that states:
''Your request for the removal of the conditional basis of your permanent resident status has been approved. You are deemed to be a lawful permanent resident of the US as of the date of your original admission or adjusment of status.
You must obtain a new alien registration receipt card (Form I-551). To do so, appear in person at the Service office below:
US Department of Justice
BCIS J.F.K Federal Bldg.
Room E-170, Boston
Bring your passport and three recent photos of the same type as you present alien card( you can obtain those photos right there) Your new alien registration receipt card will be mailed to you within six months.
You should not travel outside the US before receiving your new card.

Hi.Thank you so much for answering me.I have one more question.If i have been living with my husband for 3 years and i am going to be a permanent resident for 3 years can i apply for citizenship if i don't have my permanent green card yet.Or i still have to wait to get it and just then i will be able to apply for citezenship.Thank you so much.You are so helpful.

I asked the very same question an immigration officer when I was in Boston. That what he told me: You can file an application for citizenship, however you need enclose in application proof of your permanent residence ( which is copy of GC) But if you did not get yet your permanent GC, (your status not yet been approved), your case will put on hold untill all documents are collected and a case worker can work on your application
I personally, choose to wait for GC and then to send complete N-400.

I called, sent faxes and even visited my local BCIS center. My conditional card expired in september of 2003. I was given a stamp through July 31 of 2004. I was told If I do not receive a permanent card by then I should return to the local office and get another stamp as they are very much behind processing. I sent my I-751 to texas service center, they advised me my card should arrive by january 2004/ then I will be sheduled an interview/ yes once you receive a permamnent no conditions green card you can apply n400 but you have to be still marrried to the same us citizen you married when you came. I am divorced now. I applied to remove m conditions based on married that fell apart and I was not to blame...details will be left behind.... but otherwise just be patinet and wait. DO not divorce yet, cause if you do then you have to allow 5 years instead of three to apply for your citizenship, I don't really need it, Russia does not allow dual and I would never give it up.

Hi.Thank you so much for answering me.How many years were you married when you get divorced.Did you file for divorce or he did? Olya moi muzh podal na razvod cherez 1 god i 9 mesyacev nashego braka, razvod bil okonchatelen cherez menshe chem 3 mesyaca because i did not want it to drag forever. could not stay the face of the ashole and tolerate his humilating behaviour towards me. so we were married for a little over two years, i got my c.g.c. september 2001, as soon as my divorce was final i applied to remove conditions myself based on marriage that fell apart not because it was my fault. i filed february 2003 still waiting -case is pende they are currently working on january 2003 according to their website.

You still may receive your g.c. everybody's case is different and will be reviewed individually, if you have proof you lived together - lots of documents, financial, etc. pictures, then you are ok, it will be BCIS goal to proove you wrong but if you know you are right and entered this marriage not to evade immigration laws do not worry you will be ALRIGHT!
my advise to you DO NOT LEAVE THE COUNTRY if you do not have a current/permanent g.c. they may deny your entrance when you need to return and we do not need that. Be patient, it is tim consuming but if this is what you need you MUST STAY in the country!
if you applied together with your husband based on your marriage you may just receive your new card in the mail after about one year after filing, but processing times vary!
