fiancee visa - while waiting can you enter the country? |

Hello,
I would really appreciate if you can answer my question.
I’m a US citizen and my fiancée is a German one. As of now for us to see each other either he comes to US or I travel to Germany.
He is planning to move to US as soon as his contract in Germany is over (he is an anesthesiologist).
Could you please advise if we would have any problems if he comes here with the visa waver (as he does now) and just won't go back - we are planning to get married here anyhow, after which he would apply for a Green Card.
Or this way we are facing a lot of legal issues with INS as technically with the visa waver he is not permitting to stay in the US for more than 90 (?) days?
Is it better to file for a fiancée visa? The main questions is - if we do apply would he still be able to enter US just as a visitor with his German passport while waiting for this visa or not - approximately how long does it take to get one?

You shouldn't apply for K-1 visa. He can easy enter the United States without anyproblem. Then you get married and apply immediately for his green card. That is all.
