Hello Lev!
I am sorry for my English , but
I need your advice . Please, tell me what can I do in my situation.
I came to America with 2 my children by visa K-1( and K-2 for children) in January 2003 .I am married with American man in March 2003 . We was living with him 6 months after marrige in Pennsylvania. Our life with him was not happy but I could not change it...we depended from him completely...my husband did not want to do papers work for to change our status and papers for our Green card( he told he has not money for to pay all expences) He made papers only when we gave him money for to pay all papers work, so we send our papers to INS in August .For now our papers work on process in INS for to get the first Green Card .We have working permit, security number . Our relationship with him was not good and our marrige did not work .
I leave him in October and we came to California. I live now in California and I love man here. I would love to live with him and to be his wife. Can I make devorce with husband and to be married with man I love?
My question : What can be the problem with INS after devorce, will they send me with children to Russia for to wait visa K-3 after our marrige with man I love? How can I stay here after devorce ?
Please help me with your advice, I need be ready what is waiting for us and what can we do in my situation .

The answers for all your questions are "YES".
Yes, you can divorce with unloved person and get married to another one. However, you (and your children) have to go back to your native country and obtaine all the benefits (K-visa, greencard, etc.) over there.
INS does not permit person who came with K-1 visa and got married to a person, other than the fiancee, to obtain a greencard inside the United States.
