Dear Lev!
I found this forum very interesting and extremely helpful. Thank you, Lev, you are doing a beautiful job here.
I have a question for you. I got married to an american citizen 3+ years ago, and I received my Green Card in June 2001. I got my conditional status removed last June(2003) and if I understood the law correctly, sometime in March 2004 I should be able to apply for US citizenship. But I just realized that it can be not that easy. My problem is:
After I got my GC in 2001 I had to leave the US once but for almost 8 months - I was in Russia with my daughter waiting for my her GC petition's approval (her papers got messed up, and it took months to clear the issue). I came back with her together in March 2002. So, what's now? I can not apply for the US citizenship because I left the US for more than 6 month, can I? What should I do then? What will happen to my current Green card - it expires in June 2004 (I actually never got another GC from INS, just a letter saying that my condinional residential status was removed and my GC was extenden for 1 year (so were travel and work). Do I need to apply for a new one soon?
Meanwhile, how can I travel? I have my Mom (still in Russia) and I am very worried that I will be locked in here with no chance to go and see her ..What about my Russian passport? My Travel (zagranichniy) passport (I just got a new one a few months ago in NY consulate? Can I keep my Russian citizenship (I have an appartment in Russia, and this is the main reason I do not want to give up my Russian citizenship) and still become an American citizen?I read some of your previous posts, but only found some information about Ukranian Citizentship.
Thank you very much, Lev. I will appreciate your advice.
Alma.

Response for: Alma at 12/27/2003 10:24:00 PM There are too many issues in one questions. Any way, I try to answer your questions.
1) You supposed to received a new (permanent, for 10 years) green card. Since you have not gotten it, you have to send a special Request about the Status of your GC.
2) If you were out of the States for eight months, you should deduct this period from your three-year period for applying for the US citizenship.
3) Nothing happens with your Russian passport. Even when you receive your US citizenship, your Russian passport stays with you. When you take the Oath , you promise to renounce any other citizenship, but it is not reflected upon your property ownership in Russia.
4) For travelling purposes, I would recommend you to obtain a travel passport (Reentry Permit) that will mitigate your return to the States.
If I missed something, call me at: (305) 792-5663 or (786) 303-8114.
