Dear Kobrin,
Sorry to bother you but I want to clarify this subject, I talked to my employer's lawyer and he said don't worry and go ahead take a student visa, because we will still be your sponsor for Green Card, he said we can do your Green Card papers without you even being in US, he said your Green Card papers are in proccess and it doesn't matter whether you have student or work (HIB) visa.
What is your opinion?

Вы никогда не говорили, что Ваша гринкарта в процессе.
Но я чувствую здесь или подвох, или Вы неправильно обращаетесь с временами глаголов. Как понимать "we will still be your sponsor for Green Card"?
Если они УЖЕ подали Petition на Вашу гринкарту, то почему они "будут", а не "есть" спонсорами.
Для чего Вам нужна студенческая виза?
Дальше, "it doesn't matter whether you have student or work (HIB) visa." IT DOES, believe me. They are to call you for interview, and, in case you have changed your status, they will deprive you an opportunity to obtain GC.
If I were you, I would never risk such a thing.
