Qusetion? abandon, transfer or just wait  Roger

   Lev, I have a unique problem maybe you can help me with. My wife's son came to the states with her and after 7 months he dicided to return to Russia to return to college as english was difficult for him. He being the typical teenager and knowing more that his parents he would not wait for his advanced parole. He has since had a difficult time living alone as he is only 19 years. . I have found that I can not bring him back because he was 18 years when I brought him here the first time. My wife does not have any form of green card and can not file an I-130 for him. We are dealing with the Memphis INS office and have been waiting for an inverview for over 13 months. I made a trip to the INS office last week and was told that we could expect to wait for another 2-3 years for this interview. Memphis is now working on I-485's filed in Aug. 2001. At this rate he will be over 21 years and we will be "dead in the water" for bring him back by the time we have any type of interview. We are running out of time because he will be 21 in April 2005 I have contacted my senator's office and talked to a staffer and have had neg. results. In fact he does not return my calls. He must be getting the same result a I do from Memphis. ( J. Edgar Hoover must have been resurected and put in charge of the Memphis office }. I have explored a couple of alternatives. One is to transfer the case to another area and two abandon the case and refile where the time line is much faster. ie. Arkansas, KY, MI, or VT. I do not want to do either of these. But, I can if necessary as I am retired. I just hate the idea of maintaining two home for what ever time it take to accompolishing this. I guess there is a third, we can just wait and put it in the hands of god to get us an interview in time. What I don't know is how long it would take to transfer the case or to start a new. Your thoughts would be appreciated. Roger

You have to wait until an interview, and for the son you can use the "Child Status Protection Act", which stops the age-time from the date application has been filed. However, the son could not depart from the US without Advance Parole; therefore he could be inadmissible. If, as you say, he is "too smart", that's gonna be a prise for his smartness. I have no special recommendation on this point.
