We arrived here in the US in Nov. 1996, I was a Visiting Fellow at the NIH (J-1 visa), my wife started working in about a year. Currently I work for a company, have H-1 visa. My wife works as a contractor for one of government uniformed univercities, has H-1 visa. We do not have green card. Russia has a tax treaty with the U.S. that allows us to pay (federal) taxes back home (for 5 years). My question is, is my wife still eligible under this treaty to avoid federal tax here? (because she started working later than me). Shall we use 1040 or 1040NR?
Please help!
