Ребята, помогите, пожалуйста, советом. Не знаю , что делать в моей ситуации.
У меня просто шок.
Вышла замуж за американца несколько месяцев назад, ничего не знала о его финансовой ситуации и кредитах. На днях он мне объявил, что у нас нет денег платить кредиты за дом, машину и т.п. и он начнет процедуру банкротства. Что всё это значит? Могут ли нас теперь выкинуть на улицу?
Могут ли моего мужа привлечь моего мужа к уголовной ответственности?
Когда он брал все это кредиты, мы даже не были знакомы. Но мы поженились без всякого брачного контракта. Могут ли теперь банки требовать с меня тоже выплачивать долги моего мужа?
У меня просто голова идёт кругом от всех этих вопросов.
Я сейчас усиленно пытаюсь найти какую-никакую работу. Не знаю, чем всё это закончится.

Андрей, спасибо вам большое за разъяснения и советы.
Вы меня немного успокоили. Для меня , как для русского человека с российским менталитетом, одно слово банкротство звучит угрожающе. И здесь в Америке чувствую себя порой очень беспомощной из-за незнания местных законов.
Сейчас уже, честно говоря, жалею, что не составила брачного контракта типа "моё-моё, твоё-твоё", хотя раньше думала, что это неромантично, и некрасиво - начинать семейную жизнь с делового контракта.
Я обязательно пойду с мужем на консультацию к юристу, сколько бы это не стоило, т.к. вопрос этот очень серьёзный.
Андрей, муж внёс мое имя в свои банковские счета после свадьбы, но кредиты он брал ещё до этого в тех же банках и ставил при этом, естественно, только свою подпись. Как вы считаете, представляют ли , вообще, эти кредиты реальную опасность для меня, как для его жены?

Совсем забыла написать.
Проблем с иммиграционным процессом у меня нет.
У меня муж подсуетился со всеми документами, так что мне уже на днях прислали временную грин-кард на два года. Представляете - как быстро?
Не думаю, что кто-то имеет право её у меня отобрать теперь.

My wife and I are returned to the states on short notice. We are confronted with a problem with our finances in Western Europe. We are having problems with the situation with our house and other financial things from Europe that have placed a burden on us. Can leaving credits behind in Western Europe cause a problem with our credit in the U.S. As far as the states are concerned our credit rating is excellent according to banks but we are concerned with what could happen with the credits we left behind in Europe for our future. Dear Marina,
The United States has abolished "Debtor's Prisons" a long time ago. There is a certain amount of stigma and embarresment attached to a term bankrupt or to a person who is unable to pay his or her bills. However, our society clearly recognizes that many events beyond our control like loss of employment, bad health, accidents or catastrophic events create a cituation where an unsecured creditor (credit cards and other personal loans) loses his money. That is part of their risk of doing business, that is why they charge such a high interest rate and, if they do their job properly by evaluating risks, then they make a lot of money in the lending business. Furthermore, our society also recognizes predetarory lending practices by some lenders who are no different then loan sharks. They, certainly, do not enjoy credibility in our society when they cry wolf too many times.
Practically speaking, bankruptcy law is federal law, not state law and it gives you protection. Secured creditors (mortgage holders on your house or car) are protected by virtue of their security and you may continue to use mortaged property as long as you continue to pay them. If a bankruptcy petition is file, you will have a choice of discharging those debts as well as unsecured debts but, obviously, then and only then would you lose the property. If you chose to discharge the secured debts you will be able to keep a cerain amount of equity to yourself as it is exempt (favorable to you).
The issue of marital debts is complex. First of all, any and all property or debts acquired prior to marriage remains separate and apart of marital property and debts. Therefore, you will not be responsible for his debts which he acquired prior to marriage. You may be held responsible for debts he acquired after marriage, eventhough, you never signed on the dotted line. Thus, the debt your husband acquired prior to marriage does not present a lot of danger to you.
The decision you must make with you lawyer after careful analysis of your entire financial situation is whether your husband should file for bankruptcy protection and whether it should be a seperate or joint petition. If you avoid filing yourself, then your credit will not be affected by your husband's past. If you file jointly, do not despair; federal government will permit another mortgage for you within one year of the discharge date of your bankruptcy. Furthermore, there are lending institutions which specialize in lending money to people with credit problems or bankruptcy record. The reason for it is, that you may only declare one bankruptcy per seven year period of time.
Two words of advice: be completely honest in bankruptcy court and do not hide any assets or transfer them to frends or relatives without advice and approval of your bankruptcy attorney. It is called bankruptcy fraud; the federal government takes it very seriously and watches out for it. It is a felony, it will be prosecuted, you will be jailed and you will be deported. So, honesty is the best policy. Secondly, you have a conditional green card right now which will expire by operation of law within two years. You must submit a petition to remove conditions of your green card (Form I-751) within 90 days of your second aniversary of your marriage. Financial stress may negatively impact your marriage. At that time you will have to consult an immigration lawyer since you may have remedies to obtain the status of a permanent resident (green card) without the help of you husband. Good Luck!

I definitely need more information to properly answer your question. However, generally speaking, debts not paid in Europe will not effect your credit in the United States. Your credit problems will follow you in the United States if they are related to an international lending institution or bank or an international credit card. Other then that, you need not worry unless and untill someone sues you in the United States or Europe and obtains a judgment against you which may then be filed against you and enforced against your assets. Andrey, thank's a lot for your consultation. Can you please find out for me is ABN AMBRO bank an international lending institution or no? In this bank we got a mortgage and then had a problem to sale a house, because of market in Holland is really bad right now and bank doesn't give promission to rent it....
I know for sure that this bank has branches in the States, but does it mean that this bank is an international lending institution or it doesn't mean anything?
